A crankshaft should NEVER fail, providing the engine has been maintained correctly through it's life.
For this to be happening on a 4/5/6 year old car, and for JLR to effectively wash their hands of the issue is not acceptable, IMHO. I appreciate in the grand scheme of things, it is still a small number, but JLR should be stepping up and replacing these engines FOC, same as they should be doing with the 2.7 engines that have suffered oil pump failures too...

In your position, I'd be seeking legal advice about having a case against the retailer so you're only fighting on one front. Let them fight Land Rover if you win. You'll soon find out if it's worth pursuing legally if you go armed with the info you've gleaned on here. Disco Mikey has encapsulated it well.
Long, complicated and expensive if pushed to the courts but the retailer may buckle at the prospect of loss and the associated costs.Never take life too seriously. Nobody gets out alive anyway.

I wish I know what the reason is but their offer doesn't come with an explanation and they won't provide one ....... guess I will never know
I know that the legal route will be long and stressful but I have no other option to me at the moment.

Do we know if LR has made any changes to the crank design or assembly following their acknowledgement of the crankshaft issue in the TSB? Mitsubishi had a similar problem with the Evo 4 with spun bearings and crank failures, but quickly changed the design of the crankshaft cage ( and from memory bearings?) when they introduced the Evo 5 a year later which cured the problem. Surely LR havemt continued to churn out the same engine without modifications? D4 GS 12MY

the fact there are L405/494 with the 3.0 engines, reporting crankshaft failures doesn't fill me with confidence either...My D3 Build Thread

Ford have made changes but obviously not enough ...they probably can't be arsed to do too much as they want to offload the SDV6 as soon as and would have already if not for contractual obligations...given the relatively low numbers I suspect it's cheaper for JLR to keep paying out of warranty book funding than to drive Ford into any major overhaul now.

The big concern is not that they fail (I've heard of one that failed getting off the delivery transporter), it's the response from JLR. There is no rhyme or reason for who gets any help, and if they do then what contribution they get. They hide behind this "case by case" balldocks, bit like when you take a car to a dealer with a well known problem and they this is the first car ever with this problem. I wonder if there would be the same response if this was V8s failing at these rates in the US? If these are truely small numbers then they shouldn't have a problem sorting them out, then give the bill to Ford. But if these are bigger numbers then they'll want to keep it quiet to protect the brand so owners will get shafted.
the point is, they are making the customer pay (partially at least) for their mistakes!?--
