brake stays on, but to get it off I dont need to depress the brake, I just flick the parking brake down.

I don't think it is working correctly, if you just press down the button without touching the pedals the park brake should remain on and you should get the message
'Press brake pedal or clutch and park brake to release."
applies to my Nov 04 manual anyway.D3 TDV6SE

Ref your boot strut. Do not let it detach itself! mine came away and caused me a lot of hassle getting a satisfactory repair, it damaged the bodywork around the fastening. If you have a slim 13mm spanner, nip it up yourself if Duckworths can't fix it immediately.
