Disclaimer for events?

adding to Bodsy's post in the light of some damage that occured I was just wondering , in order to protect the site, organisers and participants of events organised via the forum would it not be wise to have some sort of disclaimer for events. something like the risks and skills involved for each event, potential for damage and requirements re. radios etc. and absolving this site if any damage may occur as after all it is just where the meeting and organising is done similar to a pub. if being organised through this site, perhaps some guidlines in organising and running an event need to be set out too in order to use the forum for this purpose. thoughts please.

I would have thought that the general rule of thumb, is
a) If you pay for a service /training, then there would/should be some liability on the trainer/adviser BUT
i) you must follow the instructions given
ii) you must not deliberately put yourself or others in danger by failing to do as instructed.

b) if you are paying (for example) to use the facility such as Boughrood or Tixover,
i) you are paying simply for the use of the facility.
ii) any instruction given by other participants should be taken as guidelines on how they have handled off road situations and not treated as training (unless a applies as well)
iii) if in any doubt about you or your vehicles ability, don't do it.

c) This site (www.disco3.co.uk) is a forum that requires no membership fee and is not a members only facility. Other non members can view and action any of the views and opinions posted on the site freely.
i) this does not bind Martin to any liability other than that of any events that he himself organises for the viewers of his site and for which they may pay to partake in.

d) events organised by other parties (i.e. ProTrax) should have their own liability and that contract of liability remains through te direct relationship the party has with the individual who has signed up

e) any individual member of disco3.co.uk can co-ordinate the meetings and arrangements of events, the role is simply one of co-ordination of a meeting of like minded individuals rather than a 'club' meeting which would require a legal commitee and organised structure/finance etc.

f) any work undertaken by any of the site sponsors would be based on a direct relationship to the forum member and the relevant site sponsor company. The banners etc are simply a point of referral.

g) ALL POSTS SHOULD BE TREATED AS REPORTS OF INDIVIDUAL EXPERIENCES RATHER THAN FOR PAID FOR ADVICE. IT IS DOWN TO THE INDIVIDUAL MEMBER TO DECIDE IF THEY WILL USE THOSE EXPERIENCES AND/OR TO WHAT EXTENT THAT EXPERIENCE IS TRUE TO RELEVANT.

Just needs a disclaimer when people sign up to a member of the site, or perhaps when first browsing the site?

Would be worth it, but there would likely be some differences in liability if they are a subscription 'club'. Still I'm sure their liability blurb could be adapted to suit the needs of the site Thumbs Up

By the fact that you put something in writing even a disclaimer does this not make you responsible. For instance if you put a notice on your gate saying that your dog bites. You may get prosecuted because you knew that it bites and you should have taken measures to safeguard visitors. If you didn't put the notice up because you were not aware that your dog bites then etc etc etc I'm sure you get my drift.
