When we go off road we are going out as a group of friends....usually on public highways and byways...which we do at our own risk and IAW the law...
When I went to Broughwood I'm sure I signed something that probably said that JV Likes took no responsibility if I damaged me, my car or anyone else....the same thing when I go on TV4x4 events....

This is a forum where we can have a chat and organise these events...nothing else....I don't think we need to turn it into something else...
If you start introducing disclaimers and somebody does do something silly then you may find that that someone will have a clever lawyer who will find holes in your disclaimer and you'll end up paying out....

It's normally the same old faces who go on these events and we all know the score....

Yes Steve it has been cannibalised from another UK event company ...who shall remain nameless Whistle .. I removed the bits that weren't relevant. I had to develop comprehensive T&C's which include elements for others to indemnify me when using the gaff......the disco3 situation is slightly different to that but I have solicitors in H&S Law in here next week so I'll put it in front of them as well Wink

Pat, I fully understand your sentiments, and would 'like' to agree, but I think that most peeps are viewing this only from the perspective of vehicle damage.... imaging if you were put out of action for a year as a result of a mishap, you may (would) think differently of the situation then and want to reclaim your lost earnings etc.

I think it is only right and fair that there should be some legal \ liability protection for disco3 and organisers which I believe will have to be covered in event costs. It would be far too late when they are stood in the dock. Sad

you insure your car never expecting to use it but it's their just in case, the site ,it's owners and organisers deserve the same respect. friends now but that can go bad very easily. I have obviously never attended an event but it appears to me that the size of these events and the likely hood of an accident are growing and not all are regulars, its a quick read and a scribble. organise an event down here and I will happily sign.

To my knowledge, the NILRC (N.Ireland Land Rover Club) organise off roading events every month (more-or-less) and DEE MORRISON (a member of this site and the NILRC) regulary takes part in his 'Disco2 on steroids' and his nice newly modified Disco3! So I will drop him a PM and ask what [they] do re. this?

(Ps, made the big 100 today Milestone at this rate (Nr. 12 months = 100) i'll be 120 years old when I hit the 1000 Rolling Eyes

Just having a quick google at their web site, here is their 'small print', but i'm sure there is more?

''THE SMALL PRINT: While we try to ensure these events are non-damaging we have no control over driver error. Due to the possibilty of driver error, or one of the rocks that mysterious appears under your vehicle, we recommend underbody protection such as diff and steering guards (available from BLRC) please contact any club member for advice. Also, each vehicle must be road legal (i.e. taxed and mot'd) for most events except those on private land, each vehicle will be scrutineed for safety reasons at each event. Ropes, shackles, ladders, hi-lift jacks, kerrs, winches are welcome additions to any vehicle but you MUST ensure you are fully conversant with the safety implications before you use them, if in any doubt please ask.''

Just a thought, but since as has been said disclaimers usually are no bar to being sued, why not tackle the issue from another direction.

If what we are concerned about is car damage from off road use - and assuming most users have 'standard' insurance not covering off road use - why not as a group negotiate a comprensive policy to cover off road events on a 'pay by the day' basis to cover the events. This way each member participating can have the appropriate insurance cover for the event and the site will not be sued for damage.... When you sign up you then have the option of taking the insurance - if you choose not to, then your case against the organisers is much weaker.

Just a thought..........

Good thining Alex08... while doing some research recently for 'classic car' insurance, myself, I found a company that covered the likes of: 'Rallying' and 'off roading'... if need be I will try to find it again and add?
