If Mr Idiot's insurance doesn't cover him/her for offroading, then wouldn't they then become personally liable, or would it be possible for them to claim from the MIBI fund (in Ireland - if you're involved in an accident with an uninsured driver, your claim is paid out from this fund - I assume there's something similar in the UK).IE - 05 D3 TDV6 HSE - Zambezi Silver

Having previously been involved in an RACMSA motor club at committee level, I can tell you that this whole thing is a nightmare, and if you wish to continue with the open forum style of 'event organisation', it will ultimately end in the incorporation of the site to 'disco3.co.uk Limited'.
At present, it is perfectly feasible that Martin could have nothing to do with organising an event, attending it or causing any grief at it. However, he could be sued by a disgruntled attendee as the 'medium' employed to instigate the event where something went wrong. I could be mistaken, but I don't know if Martin has any form of Public Liability insurance for this site, and even if he has, I doubt it would cover 'Motor Sport' events. For the avoidance of any doubt, 'Motor Sport' would almost certainly be seen to be the category of cover required for an off road adventure week-end despite the fact that there is no real competition element employed.
Much as it pains me to suggest it, I would urge you all to consider this when using the open forum to organise future 'open to all' events involving moving vehicles and potential insurance claims.
People can become very desperate when their shiny £40k motor car is written off, or a child is hurt (or such like) and their own insurance company doesn't want to pay out. I've seen friends come to blows over this in the past as large sums of money (or the potential lack thereof) can easily come between casual mates......
Furthermore, I'd still be surprised if all these insurance companies offering 'off-road-cover' would actually pay-out for something like what happened at Rockingham. I reckon the small print cover would only apply to 'proper accidents' occurring off the public highway (like a plane crashing on your car on a day of the week which doesn't end in 'Y'), and not self-inflicted incidents.......The older I get, the more I realise that people confuse wrinkles for wisdom

The events that we as forum members attend can be split into two...
Private Off Road Sites....Broughrood...Tixover....etc....
The owners of these sites will already have gone through this process and we will sign something at the time we pay to use the site....and we do this as individuals.
The D3 "organiser" is really only a point of contact between the owners and the forum members....

These are public roads and so the same rules as driving on a tarmac road should apply
The "organiser" has really only done a recce and produced some maps.
It really is no different to meeting up and driving in convoy to a LR show....
From a vehicle damaging point of view...
At Tixover everyone just did what they wanted...At Broughrood we have been organised into groups and driven round in convoy.
Personally I think the Broughrood convoy idea is a lot safer especially for people having a go for the first time. They can see how the leader has gone through an area and choose to take the same approach...or choose not to...it's their choice...
With 30 cars all doing their own thing at Tixover, it wouldn't have come as a surprise if there had been other incidents....
Everyone can also choose to listen, or not, to other peoples advice....you've only got to spend a week on the forum to work out who knows what they are talking about and who is talking out of their ....
There is roughly 3 or 4 people on the forum that I would listen too and follow their advice to the letter when driving off road....(there's probably more out there...I've just not experienced them yet)
I would listen to everyone else and then choose to follow their advice or not.....either way, if something went wrong......it was my decision and actions...
I don't expect TFC to whip out a disclaimer for me to sign before he tells me to turn my wheels to the left a bit...but there again....maybe he should

I agree that Tixover was an accident waiting to happen, but the Boughrood sessions are a lot better organised and experience is provided in the form of guidance (which gear, which setting, which direction, how much power etc).
I really felt out of my comfort zone at Tixover without the organisation and guidance (althouigh there were people there who would have given some I'm sure) as although I have a high post count, I'm still very much a novice at off roading. That's why I've got insurance to cover me, I'll follow the advice and make a decision on whether I want to 'risk' it or not. My choice, my responsibility.
So Andrew/TFC/whoever else, I'd be happy for another Boughrood session, with my own insurance, without additional liability cover and with your advice on driving skills/techniques etc.Bodsys Brake Bible

Chaps... just to highlight a point which may be being overlooked here. You might be extremely happy to say "my choice" etc ...but will you say the same when you find out that it is your insurer that is holding all the cards.
Will you still be so happy when they refuse to payout???
Let me give an example: I crashed at Boughrood and had minor body damage and my insurer paid out in full without the blink of an eye. If, god forbid, I had taken out a couple of ramblers in the process of hurtling down the hill... would they start blinking ..... I suspect that their eye would be 'ticking' a hissy fit. Basically what needs to happen is that some sort of public liability insurance needs taking out - once done that's it, except for an online agree not to sue organisers etc thingy.
FWIW I hate all this but someone will always spoil the fun.Loving the power of the TDV8!
