Thrid Party Insures have sent a letter demanding money!
Good afternoon all,
Thought I would come and vent..
We were Insured through Adrian Flux and underwritten by ERS (Equity Red Star)
So my wife had a small 'incident' last September in the D4, She was overtaking some legally parked cars and a tractor came tanking the other way, she put full left lock on and the N/S/F tyre went into the wheel arch of a parked Focus.. no the tractor didn't stop..
She was already over taking the cars before the tractor came around the corner.
So we did what was right, spoke to the owners, swapped insurance details and that was that..
I didn't claim as the damage was fairly minor, new arch, steering rack and hub, all of which I picked up from a 'prestige vehicle breakers' I inspected all carefully and also checked the vehicle they removed it from wasn't stolen.
So that was the end of that.. until today!
I moved insurance companies towards the end of last year as the quote went through the roof! now with O2 Drive who were very reasonable
So today I receive a letter from Direct Line (the third parties insurance company) saying that despite being in contact with my insurance company they have yet to pay them the £4K for the written off focus. and that I have 14 days to pay the full amount of they will initiate court proceedings against me!
Naturally I have now spoken to the under writers who have simply said to send them a copy of the letter.
How can a third parties insurance company demand money from me even though we were fully insured and fully up-to-date?

This is where old fashioned mail and recorded delivery will be your friend. Anything over the phone inputted into the system is down to the interpretation of the operator. I know how bad that can be from previous experience.

This is often the case as the claim is against you as you caused the damage.
You have an indemnity through your insurers who will pick up the bill if in the very unlikely event it goes to court, but we have often in the past had to sue when an accident has not been paid by the insurers and it is the person who had the accident that you (the third party insurance company) sue at least in name.
It is often the only way to get third party insurers to pay the bill, in your case they have dragged out paying 6 months !

As I understand things ,it is you ( wife) who are liable for any claim made against you , and you have taken out insurance to cover such eventuality, but the liability is still yours until settled with your insurance . You can of course contest the claim, but that's what you pay your insurers for. Did you advise your insurers at the time, of the incident, if not they be ignorant of any possible claim.

I would send the letter straight to you insurance company and let them sort it out, you obviously know about the incident else they wouldn't have your details unless it was a hit and run and then the police would of come a knocking and you would know about it
Hope this makes sense and don't enter into any correspondance with the demanding comapny, as said before, thats what you pay the Antique Twine Business for
