New oil pump has failed, who pays?

I had a new oil pump fitted 4 weeks ago at an independent garage, the pump has failed Big Cry
Question is, who pays the labour to fit the second new pump? The independent says as it's not his fault, he can charge labour (fair enough) does that mean it's the supplier who has to pay? Or am I going to get stitched up & going to have to pay again?

I'm sorry but if they have supplied and fitted the pump then they shouldn't be charging any labour, I believe if it's a genuine part then Land Rover will even fit the replacement.

It was not a genuine part, he recommended a genuine part but I went with a europares one that was recommended on here, not sure if that makes a difference?

How did you pay? - if paid on a Credit Card you have a route of redress - but I guess his argument will be he recommended an alternative and you chose not to follow his recommendations

Did you buy the pump from him - included in your overall bill?

Problem is, I don't think he'll do the work If I tell him I won't pay & if he does, it'll be weeks down the line, which is obviously not an option as I need my car, bloody nightmare!

Massive oil leak, apparently coming from the, as Indy explained, the little (I think he said plastic) pump thing on top, if that makes sense? He said he could replace the seal but I would be back in again in a few weeks.
