First MOT for me and my Disco 3 a few questions

So when I did the MOT refresher course the instructor was talking rubbish was he ? If your car fails an MOT a knackered TRE say and you then drive it on the road, have an accident your car has no MOT even if you had 28 days before the above test makes no difference it failed the last test and that cancels what ever was on the last test, so no MOT means no insurance, or it does all the insurance companies I've ever heard of....

Well that's me told then! Shocked

Will be having a word with my local MoT test station next week when the car goes in then as they were the ones who told me fail means fail & overrides any time left on the old certificate.

Taking it away and driving it away are two different things. I took my vehicle ,when it had no MoT, on a trailer for the very reason , as although I could drive it there for the test, if it failed I could not drive it away

The law has always been like this, the difference is computerisation as soon as the results are entered its logged and the police etc can see it, when it was the old paper system I don't anyone knew what had a ticket or what didn't unless you had parang of cause.....

There's a line that needs to be drawn between MOT validity and roadworthiness.

Failing the MOT does not render you're existing MOT invalid, but an MOT certificate is not a certificate of roadworthiness. As such, the failure of an MOT does not in itself constitue unroadworthiness, however, it may highlight an issue that would deem it unroadworthy, and as at any time, this is the owner's responsibility. To knowingly drive an unroadworthy vehicle on the road would clearly then be an offence, but also, MOT testers don't uphold the law and their findings wouldn't make it an offence if they happened to be wrong.

At the end of the day, you are responsible for the roadworthiness of your car and must act based on any information you have, which may include a failed MOT.

Sorry LFW but the new MOT does make the old MOT invalid either pass or fail makes no difference if it passes then it's MOTed for 12 months from that new date (plus the 28 days if applicable) if it failed then it failed from that date..

Then what does this mean:

You can take your vehicle away if your MOT certificate is still valid.

If your MOT has run out you can take your vehicle to:

have the failed defects fixed
a pre-arranged MOT test appointment

In both cases, your vehicle still needs to meet the minimum standards of roadworthiness at all times or you can be fined.


Question

The MOT cerrtificate is granted for 12 months and doesn't expire until then. One could be guilty of driving a vehicle in a dangerous state, but not of driving without a valid MOT certificate.

Road Traffic Act 1988, Section 48, Paragraph 2:

(a)within the appropriate period after a test certificate is issued or treated for the purposes of section 47 of this Act as issued, but

(b)not earlier than one month before the end of that period,

a further test certificate is issued as respects the same vehicle, the further certificate shall be treated for the purposes of that section as if issued at the end of the appropriate period.

If that is correct you should be able to back it up with some evidence. Maybe a link to a government website confirming what you say.
