this happened to a freind of mine many years ago involving a RS TURBO it was a couple of years old ..he was lucky it turned up at blackbushe auctions..his insurer wiped their hands of it owner negligence..this sort of scam has been going on for years..bottom line is "it don,t go before seeing the money".... : folding or cleared cheques Embarassed

Even worse. These scams have been going on for a while, and apparently some Bankers Drafts clear, then later are found to be fraudulent. Same with cheques- a 'cleared cheque' isn't always cleared- can bounce 6 months later. You lose the car either way.

I guess you either sell to commercial or do cash only (at a bank!)

cant see that myself i always wait until the funds have been transfered ...if they have no funds a cheque wont be paid..and is returned

The only way it is definately cleared is if you ask the paying bank for its fate. The return system relys on the post so it is possible that a cheque is returned many months later Crying or Very sad

This can be the case usually with a stolen business cheque that the business find out about later i.e 3 months and then the cheque can bounce and the funds returned to the original bank. Time scale seems a bit of a problem to work out but it has happened upto 5 months after the cheque was cashed.
Draw out the money and close the bank account!
If any of you have a bankers/building society draft all that has to be done is to call the branch that issued it on the phone from the number off their website or from the phone book and ask them if they have issued it. They will always check the number and tell you if they have issued it or not. This would uncover both stolen and counterfeit cheques as the banks wil usually have been informed if the cheque is stolen.
Your insurance is a dead end I'm afraid. The Police will investigate but it all comes down to resources and the fact that a car is stolen every 3 seconds in the UK. The fact you are not insured does not really change the importance of the theft I'm afraid. Most mobile phones used in these types of theft/fraud are pay as you go so can be obtained without details of name, address etc. It's a real pain trying to trace them as there is no idea who is using it. The old chestnut aswell is I just purchased it from a bloke in the pub if they should happen to find out where it is. Fingerprints off the paper is possible as is DNA but you need the Police to seize the paper as it degrades over a fairly short time.
The sad fact is that you are unlikely to get the car back anytime soon unless it is sold on with the original number and not 'ringed' in which case you will still have good title to it. The other outcomes leave it less likely that you will ever see it again. Assume you will not get it back and then it's a bonus if you do. 30% of stolen cars are never recovered.
If you want any advice regarding the Police actions let me know.

Sorry to hear about this.
If your battle with your insurance company is getting too much, I would do as others have suggested and let the press know and BBC Watchdog. A bit of publicity like this will soon make the inurance company settle up.

There's no point selling the D3 either. You'll loose a few more thousand in the process and then by the time it is gone and you're driving a cheaper car, you may have a payout from the insurance company. Then you'll be even worse off, as it will cost you more again to get a D3 again.

Matt I think your missing the point with the publicity thing ...It is a defined clause and the press are unlikely to challenge that. He could seek publicity as a warning to others but thats about it.
