Totally stitched up by Stealer, I think....

Last week I ordered 2 x Wrangler 255/55/19 tires for my car, because I kerbed it and blew them out. I sent the car to the LR dealer to do the work because the rear brake pads needed doing and it was due to go there for that anyway, also there was a problem with a locking wheel nut which they were going to resolve.

Anyway, the tires came into their stock. I have now decided that I don´t want them, but they are forcing me to pay for them. Do you think this is acceptable or even legal ?

In my opinion I am being forced to buy something I do not want to buy (regardless of whether I ordered them or not). They never asked for a deposit, never even mentioned it, had I have paid a deposit I would expect to lose it if cancelling the order, but as I never paid anything then what are my obligations to buy ?

What do you think ?

I´m inclined to think I have no obligation at all. I have owned my own business for 20 years and there´s no way on earth I would argue with the customer the way they are arguing with me, sometimes you have to bit the bullet and in this case, the tires are hardly a rarely ordered part - They are saying "they will never sell them" and they are a genuine LR Dealer. Be interested to hear your opinions.

I don´t really think its got anything to do with messing people about, I am the customer. But if we want to get onto the subject of "messing people about" then it´s them who are good at that. Hence the reason that I don´t want them anymore.

10 days ago they quoted me for the tires after the blow out incident. Now the tires are in stock they are saying I need new wheels as well as the tires and they want 500€+ VAT per wheel. This is the reason I no longer want the tires, had they have told me originally that I may need new wheels then I wouldn´t have ordered them.

So just to recap, you ordered the tyres because you had a double blow out after hitting a kerb? When your car is delivered to the dealers and they have had time to look at possible front end damage they notice you have damaged your wheels enough to warrant replacements, which after all isn't suprising given the force need to burst a tyre rated at 111. Now you have the brass neck to back out of the deal? I don't get where your coming from Question Why should the dealer be left with the two tyres in stock because you have read on the forum that Wranglers aren't the best option in that size-

Either provide your own rims or take the tyres... The rims are the only bit that are not part of the contract between you and the dealer, you asked and agreed for the dealer to order the tyres, they did.... You must fulfill your side of the agreement... There are a lot of businesses stuck with stock at their cost because of people like you... And in times like this is costing some small businesses huge losses, which in turn the reliable punters end up having tp pay for, i work in the building industry and a number of friends have had lots of pre-ordered work and materials cancelled with severe impacts on thier business and other customers....

You ordered them... Pay for them
 If it ain't broke... Take it apart anyway, how else you gonna find out how it works

I think that attitude in business is slowly changing to be honest. Everyone wants and needs customers, but no-one wants or needs customers who Censored them about. I'd tell them that you will supply the rims, and that you'll take the tyres.

Got many LR dealers in your area? Is it worth Censored ing off the only one local to you, bearing in mind you may need them in future? It's times like these that sit in people's minds, and effect whether the dealership choose to go that "extra mile" for you in the future or not.

If a customer orders a "non stock tyre" we will ask for payment up front as in the past we have been left with tyres that are not returnable without us paying a handling charge.

Many times customers cancel tyres but if they are "stock" no big problem, just screws up your stock level sometimes.

In this case it being a L/Rover garage and Goodyears being standard fit I think they are being a bit unfair, because they only have to wait and another punter will be along soon.

We still treat all of our customers as being right and do our best to keep them happy, as happy customers come back. Thumbs Up

the dealer ordered the tyres in good faith on your word prior to inspection of the wheels no doubt that would save time being without a vehicle. seems harsh to slate this move.
I undertand it seems like a good time to "upgrade" your wheels if you need two new ones and tyres anyway but this is obviously a recient thought or you would have forseen this option prior to the ordering of tyres.

at least pay for the tyres. that was your verbal agreement

but I suggest don't go for 20" wheels as they like charging at kerbs even less than the 19"s


IMHO I don't think the wranglers are "that" bad
 It is better to have and not need it then need and not have it.

My thinking is the same as AJS. It is not like it is a special order. If it was I would think you should follow through. I would be surprised it is not a stock item.

Surely the very fact that they had to order them in and they have only now come into stock would perhaps indicate that they are not a stock item for the dealership. I agree that if they are a stock item then, notwithstanding any contractual element, it would be better to just take it on the chin and move on.

I would think that when ordering the items a contract has been formed. I am not suggesting that this is the case in this instance but sometimes the stance of the company is driven by the manner and conduct that the customer chooses to take when he wishes to withdraw from that arrangement.

The LR dealer honoured your request and took you on trust that you needed them without asking payment up front. Surely you should do the right thing and honour your side of the agreement and purchase them?
