Thanks for your reply but it seems its the switch on the upper tailgate that releases the lower gate was faulty
Cleaning it now and will refit hopefully will do the job

Cleaned switch with wd40 all working fine, Thumbs Up turns out I didn’t need a new actuator as old one works fine it was the faulty switch, anyone need an actuator?
Have to say can’t understand why Land Rover didn’t fit an internal manual switch to open the tailgates
Even from a health and safety point what if someone is trying to escape out the back in an emergency
There’s no release switch, really poor design flaw, mine is a commercial so I use the tailgates all the time,
Had a nightmare job to release it from the inside when the cable snapped ,removing panels and squeezing my hand in to reach cable in actuator.
I had a disco 2 for 15 years never had any issues except it finally would not pass mot due to rear axle problems etc.
But i admit I do really like the disco 3 lovely jeep to drive and great for my work (carpenter) pity about some of its idiosyncratic design flaws,

oh dear, you've said the "J" word. hope your LAND ROVER didn't hear it ... you're in so much trouble if she did. Laughing

You can manually open the lower tailgate, just above the plastic hump in the trim there is a square recess. Put your finger in there and flick the lever up, repeat on the opposite side and tailgate will open.
