I believe the intention was to ask if the phone is locked or unlocked (SIM-free) and if locked then is it equivalent to a locked phone under contract which cannot be unlocked?
Appreciate that's not how it was worded, but it is important for a buyer to establish its status 06 D3 SE / 15 LR D90 XS SW / 88 LR 90 Td5 / 68 BMW 2000 ti

generally all phones can be unlocked either by request from the sim provider or by those with technical know how such as phone repair shops
even if it was locked to a provider you could simply buy a pay as you go sim on the same network
its the responsibility of the person who bought the phone to maintain any such contract that they initially signed up to when you take out a phone contract even if they then sell on the phone
its only phones that have been sim blocked that you cant unlock to any network sim provider usually when a phone is reported stolen
the seller indicated it was a gift and I would therefore assume no such contract exists
happy to be corrected but I know all this from experiences to date

Just to clarify a couple of things here. The handset wasn't given as part of a contract. My wife is a manager at EE and she was given this handset as a gift. From my past experiences with iPhones the first sim that is activated is what the phone gets locked to. With that in mind im pretty sure this phone will be unlocked until the first sim is inserted, but again I can't confirm this.
So, it's not a contractual handset that much I know

Correct regarding the first sim you activate it with
I just got a iPhone on O2 and put in an EE sim / activated it no problem G4 Gone ...but not forgotten

Most of the sim locking is a myth when it comes to Apple devices, 95% of them will take any sim. Very few network providers actually lock devices.
