Hi APL, sorry to read your thread. As has been said, stick to your guns. Take it to the LR dealer, even if they farm the work out, it will be under LR's control and LR remain responsible for the work.

As said definitely needs to go to a LR approved bodyshop. The car is under 3 years old, therefore it is your right to stipulate this. Major repair work not undertaken by an approved bodyshop will effect value more adversely. This is not your fault so don't accept fobbing off. If you don't want any hassle you can try a 3rd party non fault accident management company, they do all the administering and charge to the liable 3rd party. They won't let you get fobbed off with a Fiesta loan car either.

Do not use an accident managment company now as the Third Party have already accepted liability and no doubt as you haven't said otherwise they will have given you a Landrover (or something you are happy with).

Involving an outside accident management firm at this stage could result in you being responsable for their fees if later repudiated by the Third Party Insurer, as they will do nothing more for you than the Third Party Insurer is already doing ie give you a car and have yours repaired (or pay market value).

If the Third Party Insurer are providing a replacement car (Landrover) for say £300 per week and an accident management firm charge £500 per week, you could have problems later over who is paying the difference.

You have to be showing you are keeping your loss to a minimum and changing car provider part way through at a higher cost will cause you problems. However, that does not mean you have to use a repairer you are not happy with.

To be honest, at present I am without a vehicle because I was so shocked I just didn't feel like driving anything anywhere. There is a serious shortage of replacement Land Rover products over here for hire, even through Land Rover - the great Assist scheme that exists in the UK does not exist over here, all we have is a tie up with the AA to cover towing etc. Dealers have a very limited stock of replacement short term vehicles, and even where they do they are usually Freelanders.

If mine is declared to be a write-off, then my problem is that I cannot get the spec I had here. I'd have to go through Northern Ireland or the UK and pay the 13.3% VRT tax on it when I register it over here Sad

Problem is that I doubt the guilty party's insurer will want to pay out the total cost of replacement even though mine would be of quite high value, being less than 3 years old and very high spec, and less than 20,000 kilometres on the clock!

Very Happy GOOD NEWS! Very Happy

My beloved Discovery 4 is now at my own LR franchised garage for repairs, and although there is nearside rear wheel suspension damage (plus lots of body damage) they think it looks worse than it actually is and that it is repairable and therefore not a total loss.

However, it being Easter, there will now be a delay in getting the necessary parts, so will be a couple of weeks before it is returned to me, probably.

But what a relief!

APL - Have you asked the Third Party Insurer for a replacement car yet ?

Two weeks without yours is a long time without transport.

You are entitled to a "like for like" replacement and the Third Party Insurer would prefer to supply this as its them who will be paying the bill.

Hoping to sort something out yes. But as I said earlier there is a shortage of D4's available for hire, probably will have to make do with a Freelander or whatever....

Looks like they may be able to provide the Third Party Insurer with the car you should have. Its up to the Third Party Insurer to agree the cost with them once you know if they are available.

Two weeks to sort that damage properly seems very short. Remember a d3 from this forum was written off when rear wheel hit curb and bent chassis, very minor bump apparently so double check it is all straight.

Well, I can only go on what the franchised dealer reckons....... They've had it up on the ramp and reckon it's only the suspension arms which have been bent.....the chassis is intact and fine, apparently....
