I got an email today (pasted below) saying the authorities have now applied for a new permanent TRO!
Seems this has a way to run!
Chapel Gate – Experimental Traffic Regulation Order – Update
You may recall that in August 2011, the National Park Authority made an experimental traffic regulation order (ETRO) for Chapel Gate. This prohibited use of the route by mechanically propelled vehicles for an 18 month period. This order was quashed at the end of November following a challenge in the High Court by the Trail Riders Fellowship.
During the 15 month period that the ETRO was in force, the Authority carried out detailed monitoring of this route and the surrounding area. The report detailing the monitoring undertaken is available at www.peakdistrict.gov.uk/priorityroutes.
The six month consultation relating to whether the ETRO should be made permanent is now void as a result of the order being quashed. In December, we therefore commenced a fresh consultation with statutory consultees to seek views on the possibility of the Authority making some form of traffic regulation order including the restriction of the use of the above route by mechanically propelled vehicles. Details of the statutory consultees are available on our website at www.peakdistrict.gov.uk/vehicles
The outcome of the challenge to the ETRO was reported to the May meeting of the Audit Resources and Performance Committee. In addition, the Committee resolved to proceed to publication of a proposal for a traffic regulation order that will have the effect of prohibiting use by mechanically propelled vehicles at any time on this route. The Committee report can be found at www.peakdistrict.gov.uk/committees.
I anticipate that the consultation will commence later on this month. As this will be a separate consultation, you will have to resubmit any views previously expressed if you think that they still apply.
Yours sincerely

Consultation closing on 28 June |
|
There is now a consultation on the TRO for chapel gate - I have just submitted my objection via the local authorities site. Others should do the same lest we loose it. Would hate to see a domino effect if the other groups get their way. Consultation is open until 28th June - that leaves 34 days left for people to respond - remember this is a permanent exclusion order they want to impose.
Thanks

Has anyone objected to the closure? I'm trying to get on the website, but I get this:
Peak District Consultation System - Error
We are sorry, but the website or database has encountered a problem.
Typical.
One other thing, they can make a TRO to preserve the environment or wildlife, but surely, outside an existing lane the countryside and the wildlife carries on regardless of the few vehicles that go on these lanes.

Guys I don't know much about this but surely this needs both objection to this order and lobbying of the politicians.
I would have thought that somewhere in the charter or objectives of the national park there will be something about being socially inclusive and it would be worth challenging that they are not being inclusive of all users.
There are no such rights in Scotland so make sure you don't lose them.
I'll write and object. I'm to old to know everything......
D4 Gone over to the Dark Side (D5)
D3 gone ...... But now want one for knocking about! Is this a form of insanity?
