Hi all, sorry not keep anyone informed of the situation, although Bambi did pm me for an update.
The FSA have said that they think that it is a 50:50 case and have told WD that they should pay 50%. WD have said no, so it has now gone to the Financial Ombudsman. The matter will be looked at in April 2013 where I will get a conclusion.
Essentailly the FSA cannot make WD pay up. It's only the Financial Ombudsman that can make them pay. I have told the FSA on several occasions that I do not want 50:50 and that I wish to pursue the full claim and they have now told the FO that I will only settle for full payment.
When the FSA rung me up, they led me to believe that I had won full payment and that WD were going to pay up. How wrong was I!
I am in no rush, I am just careful on flashing my light at night to avoid sticking them on main beam. Hmm, maybe I should look at the post on how to fix the sticky headlight!
Thanks for the interest, but I wasn't going to post anything until I heard in April, May, June, July and on and on........

Just read this thread from start to finish. I'm appalled but sadly unsurprised.
My WD policy is due for renewal next month, I am about to attempt my 2nd claim in the policy year. The first was declined, I don't hold out much hope for this one.
Don't think I will be giving them any more of my money.

Well finally got the verdict from the FSA Ombudsman (or woman as was the case).
She declined my claim because she said that the lamps were excluded and that as the shutter mechanism is part of the lamp it's excluded.
Bizarrely when the FSA chap called 6 months ago he offered 50:50 which I declined. So she obviously over ruled him.
What I have done is buy a second hand xenon unit from fleabay for £60.00 and just swapped over the shutter.
Warranties are good, but be prepared for possible battles. I've gone down the route of save my money and put it into a pot for when (not if, as it is a Landrover) it goes wrong.
Ah we'll...........

Absolutely appalling. It shows either incompetence on the part of the ombudsman in failing to understand what a 'lamp' actually is, or perhaps worse exposes a inherent pro-supplier bias at the FOS.
Not sure if he's still around but if he is might be worth a letter to 'honest John'. If nothing else it might help bring some publicity to the case so joe public can see what they are buying before spending their money with WD.
Was there no indication of any regret or compensation for the ridiculous amount of time they have taken to reach a verdict?

No, there wasn't any apology or regret about the length of time taken. It is a joke that it has taken nearly two years
Too be honest I've moved on and the main thing is that I've got my lights fixed.
