I have to admit to driving my D3 and now my D4 around with the lower tailgate down on quite a few occasions, normally with the upper tailgate held down with a small strap through the eyes in the boot area or round the sticking out load.
I've not had an issue with exhaust fumes entering the cabin.
And have been lucky enough not to have had an issue with the police.
If need be I do have a spare plate in the car that could be attached somewhere.

Get some suckers attached to a spare reg number and stick it on the glass of the upper tailgate, either on the inside or outside.
The aforementioned boys in blue will expect that the alternative number plate can be illuminated - even if it is daylight - so the trailer board is the better idea.
