Right guys, Been to view a D4 commercial.Its a private sale, The guy has owned it from new and tells me the vat has already been paid on it by him. Should there be some sort of paperwork with the vehicle to prove this or how do I find out?

He would have paid VAT when he bought it, it's whether he claimed it back or not.
Get a receipt to say it is VAT paid.

Do you not get a printed receipt he signs or does he just write a receipt out?

If the seller is VAT registered he should sell it plus VAT, all vehicles sold from new are vatable but commercials are subject to VAT even when second hand, usually a finance company insist that the VAT is paid up front with the deposit.

If he claimed the vat back he should charge you VAT and give you a Vat Invoice with his VAT number on it. If he paid the VAT he can sell it as VAT paid.  MY18 RRS Autobiography Fuji White

If he paid the vat and is not registered for vat , he has swallowed the vat and can't charge you vat simple -------------------------------------------------
if you cant hold on dont let go , it ill come in handy for something even if you never use it.

If he bought it through a VAT registered company and claimed the VAT back he has to sell it plus VAT, if he is pocketing the money and charging you VAT he is committing fraud, whatever happens there would be no claim upon you, unless you try to claim back VAT which the seller does not charge for, which cannot happen if you are not VAT registered. At the end of the day if you buy it at an agreed price and get a receipt no-one can come after you it would be him that would have to reduce his net price to pay back the VAT.

If the vat chain is broken, ie. if the previous owner paid the vat at point of purchase and never claimed it back, if you then buy it from a vat registered company they don't have to reinstate the vat. This applies to margin and vat qualifying cars as well. Check with any accountant that does the books of a motor dealer.

All commercial vehicles are subject to VAT, unless it is a private sale. New cars and commercials are subject to VAT from new, this status drops from cars but remains on commercials.

Just to clarify, all vehicles are subject to vat when sold new apart from those to be exported and a few other exceptions. Cars sold to rental companies for example can claim the vat back and the car becomes a vat qualifying vehicle unlike others sold to the public that are classed as margin vehicles. Once again if the vat chain is broken not even a vat registered company need reapply the vat when the car is sold on. On cars that are vat qualifying the vat is not shown separately on the invoice but included in the total unless being sold to another vat registered company or person. Check with any motor trader accountant like mine is.

I think the point is being missed here, the OP asked about VAT on a commercial vehicle and could HMRC claim off him if the previous person had not paid the VAT, I was merely pointing out the basic difference between commercials and cars where VAT is concerned. In a nutshell if someone is selling a commercial vehicle and they are VAT registered they must charge VAT although the buyer may not be VAT registered and therefore cannot claim the VAT back.
