Insurance fraud: Are these two the same turbo?

Video sent by dealer in order to push a warranty claim through:
https://drive.google.com/drive/folders/0B5...EhnWHFpWVE

Screen grab:

Picture of the same turbo, two days later:

Note the soot, the markings and the wear.

Then, the actual cause of the engine cutting out:

Have you a pic of the dirty side of the air filter as Ive never heard/seen of one so blocked it stopped an engine?

Could be same turbo as 2nd pic is with the camera actually inside of the turbo and the light could reflect/act differently on the soot/dust.

The video is rubbish as all he is doing is flicking the vanes with a pen and not even seeing if theres any play in the shaft, basically hes showing its dirty on the exhaust side!
Be interesting to see the clean side of the turbo and if theres any evidence of oil passing etc.

I can get a photo of the air filter. When the turbo went into boost, the air filter will constrict airflow, causing an ECU air flow fault, putting the engine into limp mode. When I've replaced the air filter, then the car would no longer cut out.
As to the photo being black or grey - what about the markings / scratches?

Thanks for all responding.
