| Weird remote locking problem |

My D3 has developed an annoying fault with the remote central locking. It usually doesn't unlock the doors at the first time of asking when I press the button, but if I do it far enough away from the car it works fine, but up close it can take 10 presses and me getting annoyed/wet/arrested for hanging round and muttering. Sometimes I have to press the unlock and unlock buttons repeatedly until it finally decides to unlock itself. Up until the last 2 weeks, it never once failed to lock, although it now sometimes takes a second press to get it to work.
I'd swap to the spare key, but that's completely dead 
Any ideas? Is it just the battery?
