The only people who shold look are people with the same spec and model year vehicles as certain model years and specs could have different fixings for different reasons. I'm all for helping, but don't want to add something that turns out to be irrelevant and wastes the OP's time.

Let's just get this clear, then.
1. Land rover quote a maximum of 80KG on the roof? I don't remember seeing anything about a "static" load rating in the manual (but I may have missed it). Feel free to correct me as I've not got a manual in front of me.
2. The roof tent weighs 61KG alone
3. It's a roof tent, so people sleep in it? Say 2 adults at a total of another 120KG. Maybe more.
therefore total loading = 180KG plus. Unless LR have a clear statement in the manual of what the maximum loading is and it's greater than 180KG then I think you're stymied. Appeal for some ex-gratia support if all else fails.

zarnd has a good point, we are getting ahead of ourselves with the
legal aspect. We know that there has been a change in the RR rail
mounts for the non glass roof version D3, as per visual confirmation
by caverD3, the pic's by lee157 and MELISCAT. As apposed to every
body trying to peek at the said mounts, we could narrow it down
closer around the build date of MELISCAT's, his D3 is still under
warranty. My guess would be from MY 07 to MY 09 for starters,I
don't think the trim spec would influence the body shell RR rail
mounting design, except for the difference for glass and non glass.
A comparison of the build dates or MY year of MELISCAT and carverD3
could narrow it down more, thus the more facts we can put forward,
the more ammo MELISCAT has to fight his case with LR. As slimer
rightly said, this is a one off issue so far, but I do believe it is
worth the effort to pursue, it's not fair to take away a person's
pleasure by a stupid design change in my opinion. D3 bullbar-spots-roof rack with spots-ladder-long range tank-swing out spare wheel carrier- upgraded tow bar-dash console-internal water tank-duel awnings-drawer system & T T.

Hi Guys, many thanks to all of you for posting your thoughts.
The D3 is a 2008 Model, VIN:SALLAAA138A493310.
I suggest you check your VIN numbers and Build Date to see if you might have the same problem.
My real objective is to get Landrover to confirm or deny that the wrong fittings have been used when the car was built and proceed from there.
I need to get the car back on the road for August Bank holiday - otherwise a 5 week planned trip goes down the drain, so I will not be aiming for a long drawn out argument or fight with landrover.
I have contacted several roof rack manufacturers to get their understanding of what is meant by the roof loading figures, as in nearly all circumstances most Landrovers fitted with roof racks and roof tents will be over the roof loading figures and that even applies to my Td5 90.
I am awaiting feedback from Customer Services and expecting a response on Thursday. Mike

I think you may be on a hiding to nothing argueing about roof loads.
You are right trying to get LR to admit the wrong fixing was installed at factory.
As mine is an earlier build than yours, it would be a retrograde step to fit a less effective (simple nut) to later builds. I haope others will help by confirming or denying your suspicions.

I agree with carverD3, steer clear of the load ratings and stick with
the design change issue. Have spoken to my local LR spares dept,
we only get the glass roof version here and the part No for the roof
dome has not changed at all. Perhaps THE LARGE ONE may have
more in site on this, if there is more than one part No it will confirm
that there had been a planed change on the assembly line, if not,

Land Rover will also look at production codes for the vehicle as well. It could be that slightly varying specced vehicles will have different production codes for different options which could explain why you have different fixings on your roof rails than others.

Looking at the nuts there seems to be rust around the nut head, now I know you can't tell but was the nut not tight enough in the first place and allowed water in to rust and crack or as a result of the fracture, that as allowed water in and then to rust!
I'll await a telling off!!

To me that looks like it has happened as a consequence, not necessarily the cause. The main problem that you now have is that the dealership were not sure about who should pay for the repair, and Land Rover have looked at it and said no. Once a manufacturer says no to a claim it is exceedingly difficult to get them to change their minds. I know from experience when I have had a difficult warranty claim/case at work.

I think the rust would have got in after the steel cracked.
Stress fracturing to to concentrated load. This would not have happened with the corrct fixing which would spread the load.

Well folks it is bad news all round.
Landrover cannot confirm when or if there has been a change in the specification of the roof rail fixings or if my D3 is a one-off
But more importantly they say that even if there has been a change there would have been no increase in the loading figure.
They have clarified the roof weight loading issue.
75 Kg on-road
and
50Kg off-road
In other words you cannot fit a roof rack and roof tent and take the car off-road as you are likely to exceed the 50Kg weight limit
The only time that this limit may have increased is if the car was built by Special Vehicles to customer order
Everyone needs to be made aware of this, even if your Landrover is not a D3, a load reduction will apply to all Landrovers that are used off road. Proceed at your own risk!
