Chapel Gate – Experimental Traffic Regulation Order – Update



You may recall that in August 2011, the National Park Authority made an experimental traffic regulation order (ETRO) for Chapel Gate. This prohibited use of the route by mechanically propelled vehicles for an 18 month period. This order was quashed at the end of November following a challenge in the High Court by the Trail Riders Fellowship.



During the 15 month period that the ETRO was in force, the Authority carried out detailed monitoring of this route and the surrounding area. The report detailing the monitoring undertaken is available at www.peakdistrict.gov.uk/priorityroutes.



The six month consultation relating to whether the ETRO should be made permanent is now void as a result of the order being quashed. In December, we therefore commenced a fresh consultation with statutory consultees to seek views on the possibility of the Authority making some form of traffic regulation order including the restriction of the use of the above route by mechanically propelled vehicles. Details of the statutory consultees are available on our website at www.peakdistrict.gov.uk/vehicles



The outcome of the challenge to the ETRO was reported to the May meeting of the Audit Resources and Performance Committee. In addition, the Committee resolved to proceed to publication of a proposal for a traffic regulation order that will have the effect of prohibiting use by mechanically propelled vehicles at any time on this route. I anticipate that the consultation will commence later on this month. As this will be a separate consultation, you will have to resubmit any views previously expressed if you think that they still apply.
