YOU fitted the blanks as part of a fault finding exercise... As long as it's documented that you've had the issue a while, then I think you should have a good case Bodsys Brake Bible

If you can hear a sucking/whoosing noise, then something is leaking air somewhere....

If you've ruled out the intercooler hose, then the next suspect would be the intercooler as Transformer says....
It's not unheard of for them to split.
The dealer is being a bit daft - especially as they've been unable to fix it. Strap their head tech to the front bump and ask him to listen to the intercooler whilst you put your foot down.
If you can remove the front bumper cover, then you could have a good look at the intercooler and see if it is oozing oil at some place - if it is, then it's a fairly sure sign of a split in the core 2006 Discovery 3 TDV6 SE Auto Buckingham Blue

Cheers Bodsy,
I have already put this to them, I also explained that as far as I am concerned if anything goes wrong in the future then it is upto land rover to prove that the issue was caused by the bypass kit.
If they cant then it should be covered under warranty.
Let the games begin

Let the games begin Hello there! My disco 3 was driving like a turd to One
Minute then great the next and was down to a crack inthe turbo housing. Took me a while to find, also I had gearbox fault with it like yours. Everytime I slowed down for junction I dredded gassing it as this would lead to a huge unnerving clunk that sounded like propshaft loose. I did a megaflush on system and it was loads better for a bit then started again. I took the box out and inspected. The box had cooked in it's own crappy oil previously and left heavy carbon like deposits in valve block and solenoid housing. Stripped and cleaned and boxes as good as its ever gonna be! I'm not draining the oil again at a million pound a bottle!
Cheers! Live everyday as though it were your last!

Latest update :-
I have changed the intercooler & hoses, still getting intermittant limp mode.
After phoning around afew turbo specialists, it has been suggested that I could be sufering from sticky/partially blocked vain/s.
Apparently a good product to use is this,

Has anybody used this recently? I found a couple of threads from sometime ago on the forum & the results were good.
Possibly the next cheap step to resolving my issue.
The dealer is still dragging there heals, might try a differant dealer soon. d4 HSE in Corris Grey with Black options pack

Alive Tuning EGR blanking kit
Alive Tuning Re-map
Alive Atrics console
Samco intercooler hoses (from Alive Tuning)
Alive Tuning De-Cat pipe, lovely tone!
