Would that remain valid if it was attached via an adaptor arm to a square hitch receiver or does that not matter?

Sort of,

So my layman understanding is that;

As the Discovery is a Passenger Vehicle all Towing equipment fitted to the car must be 'Type approved' by law otherwise technically you are breaking the law, not insured, enemy of the state etc.

Now the hitch was always the big sticking point as if that isn't 'Approved' it was game over.

The next bit is how it's attached. Fixed to a appropriate towbar with an 'approved' adapter plate you may be in for a chance of total legality.

The trailer doesn't count as it was manufactured before 2012

That's my basic understanding. I'm sure somebody with more knowledge will wade in.
