Melbourne International Airport Fine |
|
Hi~ sorry the first post is not about Disco3s
I drove to the airport (Melbourne international) to pick up my bro this morning.
We said to meet at Hilton's car park because in the past we had no trouble of parking for 5min and pick up ppl.
But as I entered the Hilton drive "loop", I accidentally drove in from the EXIT. I quickly corrected this in 10sec. but a security guy came over immediately and said my move has been recorded on the video camera, he's here to write down my plate and will send me a 500AUD fine. I quickly apologized and left the scene. This happened around 6.45-7.00am
I called the airport and asked for the parking admin when I got home, a man told me there was no record of a car driving in the wrong direction and given fines. He asked me if I was given a ticket on the scene and my answer was no. He told me not to worry about it then hang up.
What's that mean? I'm certainly not in a good mood to receive a 500AUD for the poor design of the airport (if you have ever driven in Melbourne Airport Hilton, you'll know... ) Does anyone know if the parking company is able to fine for traffic offenses in a car park?

is the airport private land, if so then no. as far as I'm aware only officers of the court can issue infringement notices. sounds suss to me, if you're on camera, why the need to manually record your plate. maybe ask the guy if he knows the penalties for fraud. best check with a leagal eagle if you're concerned, if anything ever turns up that is

This sort of cr p realy gets my hackles up Most ariports are so confusing I do not know eneyone finds there way around. Having to pay for parking is another thing that gets my back up
We pay stamp duty on the car, We pay for rego, We pay exercise duty on fuel, We pay GST on fuel which is on the retail price plus the exercice tax which is a tax on a nother tax [ which is forbidden in the Aust constitution!] and they get away with this, THEN THEY MAKE US PAY TO STOP THE CAR,
The taxes and charges made by goverments are a ripoff, There is no value for money in this.
Good luck hope no fine comes in the mail, if so fight the b :censored:ds.

Sydney airpoert are now forcing cars to use the car park when picking up passengers: they are fing you for picking up passengers at the departures let off area! “There are only three sports: bullfighting, motor racing, and mountaineering; all the rest are merely gamesâ€

With airports now owned by infrastructure companies like Macquarie Airports Group you can expect more of the same as they squeeze every dollar out of the asset they can.

Andy V6SE - I havnt been around for a while - hope my reply is not too late (i.e. hope you have not paid anyone $500!).
The basis a private car park uses to "fine you" is for your breach of contract - the contract entered into between you and the car park when you drive in.
A penalty provision in a contract is unenforceable at law - the only thing you can contract for is for damages. Sometimes a contract has an amount agreed for "liquidated Damages", which is meant to be a "pre-estimate" of the damages to be sufferd by one party should the contract be breached by the other.
I would find it hard to believe that the car-park operator could have suffered a $500 loss buy your driving in the wrong way. If they send you a fine for $500 ask them on what basis they are charging this amount. If they do not have the backing of some regulation or another (like the private toll roads do), tell them you think it is too much. If they persist, take your story to the small claims tribunal.
Anyway - good to be back on-line
(this theory also applies to the local shopping centre carpark - if you dont pay the $2.5 an hour, how can they "fine" you $50?? The greatest "damage" they can suffer is a loss of $2.50 an hour!!! Anything they want to charge more than that is a penalty and void) Is God willing to prevent evil, but not able? Then he is not omnipotent.
Is he able, but not willing? Then he is malevolent.
Is he both able and willing? Then whence cometh evil?
Is he neither able nor willing? Then why call him God?

Tristan, Does this apply only to private carparks, what about council carparks, We have lots of them with very efishase brown bombers ready to put a brown envelope under our wiper blades with a nasty fine.
Years ago I contested a parking fine and won, but after all the hastle and time wasted it was not worth it. These people know it is cheeper to pay up than fight it, they use it as revenue raising

Hi Rob.
Sadly, Council has the backing of statutes allowing them to give us fines (as in penalties)...which makes them the government...and the government can do anything we let them... Is God willing to prevent evil, but not able? Then he is not omnipotent.
Is he able, but not willing? Then he is malevolent.
Is he both able and willing? Then whence cometh evil?
Is he neither able nor willing? Then why call him God?

Hi everyone!
Thank you for the replies! Has been almost a month and no fine has received yet.
To TDMP,
a friend who studies law also told me if there is no damage to the private property, they don't have any rights to charge/fine me, especially at this amount! Even driving on the opposite lane on public roads doesn't get fined this much...
I'll definitely challenge if the fine comes!
