I guess you were recovered from the BOAT? Otherwise can you not say the fault occured elsehere? Forgive me if I am stating the obvious!

It's water damage and no professional recovery firm was needed.

If it is a public right or way (and if you haven't done, probably worth an email to the relevant County Council's ROW officer to get it in writing) Then the law of the land says it is a public highway, and your insurance should cover you for the public highway.

Then the job's a good 'un.

Someone on the DOC forum did quote some case law on this but I can't find it at the moment.

Quoted from Shooting Times 19/04/07 (I C&P'd it from DOC Forum)

"4x4s Insured Off-road

Are you insured off road perpetuates a rural myth about motor insurance. for third party risks, the policy holder is insured at all times and places in theEU (see Art 3, Council Directive 72/166/EEC, which covers the use of a motor vehicle in the EU). There is no mention of a road in this directive; it was very broadly drawn to cover thedifferences between different jurisdictions, so that an innocent victim of an accident concerning any motor vehicle anywhere in the Eu would get compensation. All passengers in the vehicle have been covered since 1990 (Art 1,90/232/EEC). As to comprehensive cover to damage to the vehicle itself that will depend on the specific words of the policy, but unless comprehensive cover off-road is excluded then the policy holder will be covered. This myth is one reason why drivers of 4x4s are loath to get their tyres dirty.

For any one wanting a more indepth sight into this look at the case of Bernadez (a decision of ECJ, case number C-129/94). This gives a detailed discussion of the law. "

You should be fine with the claim on the "BOAT".

I sustained over £1500 worth of damage on my RR some years back & Norwich Union were fine when I explained that I was not "off road" but rather on an "unsurfaced road"

It's all in the language that you use. You need to be factual but without giving away the unnecessary.

By the way if your granny need to be taught to suck eggs........

But serioulsy, there should be no reason for problems.

BTW how deep was the water?.

The problem you're going to have then is proving that it happened after cover was purchased.

Look for any dated/timed parking tickets etc that show you were out and about in your vehicle the days before it packed up.

Good luck!!

NFU you should have no problem, but you're going to be putting my premium up next year.... Twisted Evil

They cover off road as standard, unless it's competitive time trials. Not that you were technically off-road, just off tarmac.

Dear NFU, I'd like to make a claim as I drove through a puddle........ (OK, so it was a big Censored off puddle, but a puddle nonetheless..... Smile )

The car is completely drivable - all that isn't working is the sat nav, DVD, CD, Radio, Telephone - basically all the fun bits. The puddle was deep enough to fry the electrics! Evil or Very Mad B

Hey VA, jobs a goodun mate.
You should be covered for this excursion as a BOAT is a public right of way and not considered off road.
