Help, just bought a D3 and thinking about taking it back

I picked up a 58reg D3 last weekend

When you get your money back name and shame and also stick the reg number of the motor up in case the next potential owner happens to do a search

Any fault warning light showing on the dash is a MOT fail, not advisory, take it back ASAP, threaten them with Trading Standards if they quibble, it is a serious offence for a trader to sell an unroadworthy vehicle, this vehicle is unroadworthy regardless of what the MOT says and may have other major faults that they have hidden Thumbs Up

agree with all of the above … and if you paid any of it on a credit card, call your card supplier. If you think Trading Standards have clout, you ain't seen what the credit card companies can do.

Once you get your money back and if you still want a D3, buy one privately, preferably from the classifieds on here. Seems like you know what you are looking at once you get underneath.

Who did the MOT test?- if they did it they are in big trouble, if they didn’t then whoever did is in big trouble, or was it done at all?

P132b, is a boost fault code, pretty sure an over boost and generally related to the turbo, will not be related to EGR. Make sure the linkage is completely free offering almost no resistance when pushed and pulled but if it's not that then it may be the actuator itself and may need a new turbo.

Given the way the garage have deceived you then I agree with the others and it needs throwing back at them.

I spoke to the garage today, the bloke that sold me the car was very argumentative as expected. It took nearly an hour but I managed to tell him about all the issues and asked for a refund. The guy told me that nothing I was complaining about was good enough to warrant a refund. If I wanted to go down the refund route I would have to take it back to him to check what I am claiming is correct and then I would have to take him to court. I'm not inclined to take it back to him as I don't trust the garage. I feel it should be inspected by someone independent.

He also insisted that having the egr delete was causing P132b fault with the actuator. Something I would like to know the answer to is whether anyone has experienced this? What are the chances of that fault code going if the egrs were reinstated?

I'll contact consumer advice or the motor ombudsman tomorrow for some advice on an independent inspection and the next steps.
Interestingly their website says they're a member of the motor ombudsman, however searching the ombudsman's site I cannot find the garage listed. Probably false advertising.

I thought about taking the car to my local council MOT centre but if it does fail a test then how am I supposed to drive it away? Doesn't it need to be trailer away?

I'm sure I would win my case, I just need to record all the evidence. One thing I'm worried about is the garage closing down and starting up with a new name so the original business doesn't exist to refund me.
Another worry is about how nasty the bloke can get, he knows my address.
