Can you help me with this sales invoice please?
I've had my D3 for 5 days and she is riddled with problems. I really want to fix her and keep her, but after the low rider experience again on the M26 and M25 today and having to keep pulling onto the hard shoulder to try and re set it and losing my brakes at other times. I'm going to have to try and take her back.
Now, as I've said in one of my other posts, the dealer, sold the car from his house due to Covid and has written private sale no warranty on the invoice, but he has written his business name and address on the invoice. I've attached a pic. What do you guys think? I'll call citizens advice tomorrow too, but you're all so knowledgeable, I thought you could look for me.

Have you checked what legal cover you have though your car insurance / vehicle recovery / home insurance as well?

Where/how did you see the vehicle advertised for sale?
What did that say?
Private or trade sale?
Either way it's messy and you need to find all the 'trade sale' markers that you can.
I am pretty sure that even a Trader can sell a vehicle that they've taken in as a 'part exchange' without warranty and sold as seen.
As I say, it's messy but find all the pointers to a Trade sale and then reject the vehicle.

This doesn’t help you at all but “here” any sale by a representative of a company OR at the company premises, etc. is automatically considered a B2C type of sale. A dealer cannot limit its exposure in such a way.
Also, dealer cannot sell a vehicle to a consumer without any warranty or “sold as seen”, either. Only possible in B2B sales.
But really, the whole invoice is full of disclaimers and even a typo (finance spelled wrong)...

It was on Facebook, it's still on their FB page! Which is under their business name. Where the pictures have been taken is where I picked it up from.
Sold as seen from a dealer is illegal from what I have read, but I don't know what I can prove. He could only sell a faulty car as a non runner or spares and repairs.
I'm with the RAC so will see if they can help me too.

If there is any suggestion that it was sold via the business, then you are covered under SoG
The fact he has written his business name on the invoice works in your favour, regardless of him writing spares/repairMy D3 Build Thread

I think it's related to the old po17 recall failing, but still the brakes are intermittent!
