Adrian Flux, buyer beware!

I have just recently completed a years insurance with Adrian Flux. During the period we had our car vandalised and subsequently made an insurance claim to have it fixed at a cost of £4k. We we enquired about the status of our no claims bonus before proceeding, and were sent a letter stating that it would not be effected. We went ahead and had a LR approved garage carry out the works.
We have just received our renewal letter and our premium has gone from £678 to £2500 and our no claims bonus has been nullified.
I have spent hours on the phone with customer services and their claims dept. to no avail they are now saying that the letter is a mistake and unless I pay RSA (the underwriters) back the £4k I will not get my 40% NCB reinstated.
I wouldnt mind so much but this mistake makes our vehicle completely unaffordable and nigh on uninsurable for the future.
Does anyone know what my legal stand point is on this?

Shop around with other brokers & insurers - try Footman James?

Also tell Adrian Flux about this thread, and threaten to join lots of other BBSs to warn everyone of the way you have been treated.

Complain to Honest John of The Telegraph - generally make a stink, they won't like it.

The Insurance Ombudsman is there to deal with things like this. http://www.financial-ombudsman.org.uk/consumer/complaints.htm

If it is in the policy conditions, and they confirmed it in writing, you are in the clear.

Sorry but if they put it in writing, then they have to make up the difference themselves. They are a broker and as such are regulated to give advice. If they get it wrong then they have to compensate you. I would make a official complaint and the.
n take it to insurance ombudsman.

I posted a similar thread a while back after something very similar happen to my dad. Are you sure its your NCB that has gone, as one or two folks on here who are in the insurance industry told me that it was more likely your starting premium had been loaded up due to your claim, and even with 60 or 65% NCB discount, your policy is now much more expensive (Dad's went from 400 to over 800, so not as bad as yours)

Otherwsie, as mentioned already, try the insurance ombudsman, especially if you've written evidence about not losing your NCB.

What does last years policy say. It will specify whether you have protected No Claims Discount and if so what the terms are. Mine was upto 3 claims in 5 years.

Saying that I never made a claim so I guess it may have been the same argument if I had,

I have it in writing on the renewal that my NCB has been zeroed, and also in a separate letter that my NCB will not be effected because of the claim.
Adrian Flux has made a serious error and is trying to flippantly pass the buck onto me and as a broker is telling me that I have to pay RSA back the 4k which is a ridiculous situation, an insurer takes on risk at a price ? Sometimes they win and others not.
The problem is that the ombudsamn is going to take months of wrangling and I need to get insured ASAP.

You need to put your complaint in writing for sure and Personally I'd go to another insurer to get a quote anyway.

Go straight to the obudsman. You contacted the insurers first before carrying out repairs, they sent you written confirmation of your and their position on the matter - they effectively gave you a written contract.

If the letter was wrong, that's their problem and they responsibility - based on my experience of the financial ombudsman, I'd be extremely surprised if the ombudman doesn't find in your favour and tells the insurers to cough up and wind their neck in. Good Luck.

One of the big insurers (is it Direct Line?) cover vandalism with some additional benefits such as protected no claims. Used to be an advert on TV - did a pile of bricks land on a car in it? Anyway, if anyone can remember the firm, it might be worth trying them for a renewal cost too in case they're more relaxed about your previous claim?

Get quotes from others, most offer a good introductry discount which would take some of the pain and cost out of the situation even with this claim on your file.

Would of expected to lose the NCB if in this situation as it not protected and with insurance it is who has paid out rather than who's fault it is that dictates how your ncb is worked out.
The letter may be your get of jail, but would view it as they say as being a mistake.

If you had known or been advised of this when you first contacted them would you of taken a different course of action over the repair Question
